Acceptance of Terms 

Before you use the services, we require that you read and accept these Terms and Conditions.  If you visit, shop or otherwise participate in the services on this site, you accept these Terms and Conditions.  If you choose not to accept these Terms and Conditions, you may not access or otherwise use the site or services.  If you have any questions regarding these Terms of Service, please contact our Customer Service department by calling (973) 762-5588.  In addition, when using particular Mona Lisa Artist Online, LLC owned or operated services you shall be subject to any posted policies, guidelines or rules applicable to such services.  All such policies, guidelines and rules are hereby incorporated by reference in the Terms & Conditions, including Mona Lisa Artist Online, LLC privacy policy. 

Amendment 

We may, at our sole discretion, change, modify, add or remove any portion of these Terms & Conditions, in whole or in part, from time to time and at any time, without notice to you, by posting such changes on the Site.  Your continued use of the Site and the Services after such changes are posted will constitutes your agreement to such changed Terms & Conditions. 

Capacity to Contract 

The services provided on this site are available on to individuals or entities who can form legally binding contracts.  Without limiting the foregoing, neither minors, (persons under the age of 18), nor individuals who have been suspended from the services may participate in the services provided on this site.  If you are under the age of 18, you can use the services only in conjunction with, and under the supervision of, your parents or guardians.  If you are registering as a business entity, you represent that you have the authority to bind the entity to these Terms & Conditions.

Information for Customers

Unless otherwise stated, all prices on the Site are in U.S. Dollars.  Customers (that is, purchasers of items from the Site) are responsible for paying all fees and applicable taxes in a timely manner with a valid payment method.  If a Customer’s payment method fails, Mona Lisa Artist Online, LLC may collect fees owed using other collection mechanisms.  Mona Lisa Artist Online, LLC may at any time, delete, modify or supplement the content and prices of the site without prior notice.  Mona Lisa Artist Online, LLC reserves the right, for any reason, at its sole discretion, to terminate, change suspend or discontinue any aspect of the sit or the services, including, but not limited to, content, features, pricing, or hours of availability.  Mona Lisa Artist Online, LLC may also impose limits on certain features of the services or restrict your access to part or all of the site or the service without notice or penalty.

Purchasing Art

You must be a registered user in order to purchase art.  Customers are obligated to complete the sale transaction upon completion of the check out process.  Customers are liable for the posted purchase price of the piece(s) of art, any insurance, packing, freight and shipping fees associated with the purchase, and any applicable sales tax (collectively, the “Purchase Fees”).   
 
 

Payments 

Payment for the art may be made by credit card as specified on the site.  All posted purchase prices are listed according to their value in U.S. dollars.   

Delivering Purchased Art 

The pieces of art shall be packed and shipped to the address specified by the customer.  The piece(s) of art shall be packed so as to protect them during shipment.  Mona Lisa Artist Online, LLC shall not participate in the packing and shipping process, and in no event shall Mona Lisa Artist Online, LLC be liable for any damages of any kind arising from the packing and shipment of any art.  Artwork must be shipped within 14-21 days from date of purchase.  A seven-day grace period is allowed; however, if at the end of the grace period, the artwork has not been shipped, the customer will be contacted and the order may be cancelled.  The purchase price will be refunded to the customer.  If an order cannot be delivered to the address provided by the customer and the artwork is returned to Mona Lisa Artist Online, LLC, the order will be treated as a return.  The customer is responsible for the costs associated with all freight, shipping and other costs related to transporting the art from Mona Lisa Artist Online, LLC location.  The art shall be and remain the risk of the seller until it is shipped to the customer, and thereafter the risk shall shift to the customer.

Return Policy

Unless otherwise stated for a particular piece of Art, a customer must notify Mona Lisa Artist Online, LLC of his or her intention to return a piece of Art within four (4) days after the date of customer’s receipt of such piece(s) of Art, (the “Return Period”).  No returns will be accepted after such period.  After marking the order as returned, the customer must ship it to Mona Lisa Gallery & Framing, Inc, 168 Maplewood Ave, Maplewood, NJ 07040, within ten (10) days of receipt of the art.  If the return is not shipped within ten days, it will be cancelled and the order will be paid to the Mona Lisa Artist Online, LLC.  If for any reason the customer receives damaged art, we will replace it immediately, at no cost to the customer.

Return Process

If a customer elects to return a piece of art, the customer must mark the order as returned during the return period, within four (4) days of receipt.  If the returned piece of art has not been altered and is returned within the return period, ten (10) days of receipt, Mona Lisa Artist Online, LLC shall accept the returned piece(s) of art and notify the customer of its acceptance of the returned piece(s) of art.  Mona Lisa Artist Online, LLC shall process the return and reimburse the purchase fees less any insurance, packing, freight and transport fees associated with the customer’s purchase.  Reimbursement shall be made to the customer by issuing a credit card refund.  Insurance, packing and shipping fees associated with the return of the returned pieces of art shall be the sole responsibility of the customer and Mona Lisa Artist Online, LLC shall have no obligation to reimburse the customer for such amounts.
